Then he accuses Newsom of causing deaths & “potential deaths”.

He also claims without his illegal action of sending in the #military against the wishes of the governor & mayor that “LA would be burning to the ground.”

#JamesWoods, the actor who has become known for spreading #ConspiracyTheories, used his account on X to rail against the #state’s elected ofcls, especially #Governor #Newsom, a Democrat. He also reposted a fabricated quote, attributed to President Barack #Obama, discussing a secret plot to impose socialism on the country, as well as a video of burning police cars that was from 2020.

The confrontation escalated on Monday as new #protests occurred & #Defense Secy #PeteHegseth announced—on X—that he was mobilizing 700 #Marines from a base near #LosAngeles to guard federal bldgs. They are expected to join 2k members of the #California #NationalGuard whom #Trump ordered deployed without the authorization of the #state’s #governor, #GavinNewsom, who normally [legally] has command of the #troops.

#Trump’s rush to deploy #California #NationalGuard troops to #LosAngeles has left soldiers without adequate sleeping arrangements, forced to pack together in one or more federal buildings, resting on the floors of what appear to be basements or loading docks….

The state #troops federalized by the Trump admin over the wknd to confront #immigration #protesters, without the approval of #Governor #GavinNewsom, were “wildly underprepared,” said a person directly involved w/the deployment….

“The issue here goes beyond #LosAngeles or #California: If the president of the #UnitedStates can, without notice to the #governor & without the constitutionally required request of the governor, send the #military into our city, he can do so in any city in America at any time & for any reason he may conjure,” the group said in a rare public statement. The statement was signed by nearly two dozen #civic leaders….

The activation of #Marines came the same day #California sued the #Trump admin over the deployment of #NationalGuard #troops in #LosAngeles.

In their lawsuit, California #Governor #GavinNewsom & state AG Rob Bonta said Trump's activation of the Guard violated the #10thAmendment of the US #Constitution because Newsom did not ask for the #troops.

The #Democratic Governors Association condemned #Trump’s decision to send #NationalGuard #troops into #LosAngeles over the objections of Governor #GavinNewsom as “an alarming abuse of power.” The association, which includes every Democratic #governor in the country, said in a statement that they stand with Newsom.

#California #Governor #GavinNewsom just formally asked #PeteHegseth, the #defense Secy, to rescind #Trump’s #unlawful order to deploy the #NationalGuard in #LosAngeles. “We didn’t have a problem until Trump got involved,” Newsom said in a social media post. “This is a serious breach of #state #sovereignty — inflaming tensions while pulling resources from where they’re actually needed.”

The situation in #LosAngeles, #California is a new one. #Trump has called up the CA #NationalGuard, not another #state’s guard. So there’s no #FigLeaf despite the fact that both the #mayor & the #governor have objected to the action.

This SHOULD make the act illegal acc/to the #PosseComitatusAct without the express invocation of the #InsurrectionAct.

The fig leaf Trump is attempting to employ is the assertion that the guard will only be protecting #federal personnel & property.

That right is meaningless if the #president can simply approach a different #governor & ask her to deploy her state’s #NationalGuard into the unwilling governor’s #state. In this scenario, the cooperating governor becomes a #FigLeaf for the president to use the #military as a #police force anywhere in the country, free from the constraints of the #PosseComitatusAct.

The deployment of non-federalized, out-of-state #NationalGuard forces into a jurisdiction WITHOUT its consent represents another threat to the #PosseComitatusAct. When operating in #Title32 status, Guard forces are exempt from the Act because they are under #state command & control. A key part of that control is the #governor’s right to DECLINE a particular #federal mission.

Members of the #NationalGuard are rarely covered by the #PosseComitatusAct because they USUALLY report to their #state or territory’s #governor. That means they are free to participate in law enforcement if doing so is consistent w/ state #law. HOWEVER, when Guard personnel are called into #FEDERAL service, or “federalized,” they become part of the federal #ArmedForces, which means they ARE bound by the Posse Comitatus Act until they are returned to state control.
