Its lawyers are expected to seek to narrow prior court rulings & also defend against an anticipated rise in #ClassAction lawsuits challenging #Trump policies.

Lawyers in the unit are opposing 2 attempts by advocacy organizations to establish a nationwide class of people to challenge Trump's order on #BirthrightCitizenship. A judge granted one request on Thursday.

The process to certify a class can often take months. A snr White House ofcl told Reuters the #Trump admin will be watching #class certification decisions closely & plans to aggressively challenge them to prevent “abuse”of the process.

The govt says the named class plaintiffs in the New Hampshire case are too different from one another to be able to proceed as a #ClassAction. They include an #asylum seeker & someone on a #StudentVisa.

The plaintiffs in the NH #BirthrightCitizenship case are looking to seize upon one of the major exceptions to #SCOTUS’ ruling. They argue it allows #judges to continue to block #Trump policies on a nationwide basis in #ClassAction lawsuits.

The lawsuit, which was filed by the #ACLU & others hours after the Supreme Court ruled, seeks class action status on behalf of babies who would be subject to Trump's #ExecutiveOrder & their parents.

Many class action lawsuits related to data breaches get dismissed for lack of standing when plaintiffs cannot show concrete injury or imminent harm. Or when they do allege concrete harm like fraud or IDtheft, they may have trouble showing it was due to that specific #databreach and not any of a gadzillion other breaches that have occurred.

In Webb v. Injured Workers Pharmacy, the lower court dismissed the suit because it didn't think the plaintiffs made a clear enough showing of tracing the harm to the breach.

The appellate court reversed and remanded.

After that, the case settled for more than $1M.

In a historic win for data protection and privacy, the High Court of Ireland has this afternoon granted ICCL permission to take Ireland’s first ever class action. The lawsuit targets Microsoft’s vast online advertising business.

The litigation is anticipated to affect Microsoft’s operations across Europe, because Ireland is the venue of Microsoft’s EU headquarters.

Dr Johnny Ryan, Director of ICCL’s Enforce unit, is leading the case. Speaking after the hearing, he said:

“The significance of today's decision extends beyond just Microsoft. Ireland is also the HQ venue for Google, Meta, TikTok, X and Apple. Today, nine years and one day after the GDPR was first introduced, we are finally opening up a way to enforce it against big tech on behalf of everyone. Regrettably, the Ireland’s Data Protection Commission has paralysed enforcement of EU data law. But that need no longer be the case.”

The litigation follows research by ICCL Enforce that uncovered how people’s intimate relationships, finances, and other secrets, are broadcast by Microsoft into the Real-Time Bidding (RTB) advertising system. Microsoft’s RTB system operates behind the scenes on websites and apps to match advertising to specific people.

ICCL argues this system is exposing users to malicious profiling and discrimination. It also argues that the system is undermining European security.

ICCL is taking the legal action on behalf of all affected people in Ireland under the new EU Collective Redress Directive. The organisation hopes to force Microsoft to bring its systems into compliance with the EU’s General Data Protection Regulation (GDPR).

Posing as a data buyer, ICCL Enforce obtained thousands of RTB data “segments” about Irish people. These include information such as whether a person gambles, their finances and debt, and even such sensitive information as whether the person works in a sensitive national security role.

The lawsuit, filed on May 8 in Philadelphia, seeks to represent a class of everyone who signed or referred someone to sign the petition & was not paid in full.

#Musk’s #PAC also pledged to give away $1 million daily to someone who signed the petition in support of Constitutional guarantees to freedom of speech & the right to bear arms. A separate proposed #ClassAction has claimed the giveaway was a #fraud.

Justice Kagan asks Sauer to assume that #Trump’s EO on #BirthrightCitizenship is unconstitutional. Since Sauer is questioning whether a #ClassAction lawsuit would be viable in this matter, how long would it take for #SCOTUS to resolve the matter if everyone had to sue individually?

Kagan’s question gets at the practical impact of abolishing #NationwideInjunctions: She is suggesting it would be a chaotic process for many individual plaintiffs across the country fighting for citizenship.
