During oral arguments in January Justices indicated the landscape of the porn industry had rapidly transformed since the court last issued a major decision dealing with explicit material, about 20 years ago. Today, porn sites & smartphones allow easy access to adult content.

It is by Justice #Kagan, & the vote is 6-3 again. #Gorsuch dissents, joined by #ClarenceThomas & #Alito.

Clarence Thomas is a terrible human being.
He wants to "reconsider" a section of the Civil Rights Act of 1871 that permits the federal government to sue states and local governments for violating constitutional rights. It is the underpinning of much federal civil rights litigation.

The assertion by #ClarenceThomas that “we survived until the 1960’s without universal injunctions” has been challenged by legal scholars who found examples of the tool's use going back as far as 1913, when #SCOTUS itself temporarily blocked the enforcement of a federal #law not only against the plaintiffs in a case but others as well. In other cases from the 1930’s, lower courts issued statewide injunctions blocking the enforcement of state laws.

But now #Roe's survival was very much in doubt, as was starkly revealed by the Pennsylvania anti-#abortion regulations under review in Casey. 3 years earlier, Chief Justice William Rehnquist & Justices Byron White, Antonin Scalia & Anthony Kennedy had signaled their desire to overrule Roe at the first available opportunity, & few observers doubted that the Court's newest & most controversial member, #ClarenceThomas, was eager to join them as the fifth & decisive vote.
